The likely result of the FDA’s release of the rule before the Trump administration begins is to protect the rule from being discarded and to allow the agency to begin collecting comments from the public but not pursue any action on the rule. The agency appears to anticipate this by having an extended comment period that runs from January 16 through September 15, 2025. It is unlikely that the rule will be finalized under a Trump administration, but the comment period allows the FDA to begin work for a future time when a less hostile administration may be in office.
